Thanks for using MCC Hosting's services which are branded as “MCC Hosting”.
These Terms and conditions contain the terms under which MCC Hosting and its affiliates provide their Services to you and describe how the Services may be accessed and used. You indicate your agreement to these Terms by using the Services.
1.0 Legal Compliance
You represent and warrant that you will comply with all laws and regulations applicable to your use of our Services.
1.1 Your responsibilities
You are responsible for your conduct while using our Services. You must comply with the following requirements when using our Services:
1.1.1 You may not use our Services to infringe the intellectual property rights of others, or to commit an unlawful activity.
1.1.2 Unless authorized by MCC Hosting in writing, you may not resell or lease the Services provided to you.
1.1.3 You may not engage in abusive or excessive usage of our Services, which is usage significantly in excess of average usage patterns that adversely affects the speed, responsiveness, stability, availability, or functionality of our Services for other users. MCC Hosting will endeavor to notify you of any abusive or excessive usage to provide you with an opportunity to reduce such usage to a level acceptable to MCC Hosting. Failure to comply to our notice may result in the suspension of your services.
1.1.4 You must not abuse our free trial service by continually cancelling and resubscribing in order to achieve the effect of an extended free trial. By doing so, you risk a backlist from our services.
1.1.5 Unless authorized by MCC Hosting in writing, you may not probe, scan, or test the vulnerability of any MCC Hosting system or network
1.1.6 You may not misuse our Services by interfering with their normal operation, or attempting to access them using a method other than through the interfaces and instructions that we provide
2.0 Money Back Guarantee
If for any reason you are unhappy with our services, We provide you with the option to cancel your services for a full refund within 7 days of placing your order. After 7 days, a full refund is no longer possible and a cancellation will only result in the termination of your contract with us at the end of the current billing period.
Any abuse of our money back guarantee including excessive use of this guarantee with new services you take with us is not permitted and may result in a blacklist from our services.
3.0 Always backup your data
You are responsible for maintaining, protecting, and making backups of your data contained within our servers, for example, your server files contained wiithin our hosted servers. To the extent permitted by applicable law, MCC Hosting will not be liable for any failure to store, or for loss or corruption of, your data.
4.0 Suspension and Termination of Services
4.1 By You
You can terminate your Subscription at any time either by emailing us, or cancelling your recurring subscription from within PayPal. Such termination will result in the deactivation or disablement of your services and access to it, and the deletion of any data contained within our services at the end of the billing period. You will not be charged again for that Subscription unless you purchase a new one. If you terminate a Subscription in the middle of a billing cycle, you will not receive a refund unless you are terminating within the period of our money back guarantee. You are responsible for backing up any data before termination as ternination will result in the loss of any data contained within the services.
4.2 By Us
MCC Hosting may terminate your Subscription at the end of a billing cycle by providing at least 30 days’ prior written notice to you. MCC Hosting may terminate your Subscription for any reason by providing at least 90 days’ written notice to you and will provide a pro rata refund for any period of time you did not use in that billing cycle. MCC Hosting may suspend performance or terminate your Subscription for any of the following reasons: (a) you have materially breached these Terms and failed to cure that breach within 30 days after MCC Hosting has so notified you in writing; (b) you cease your business operations or become subject to insolvency proceedings and the proceedings are not dismissed within 90 days; or (c) you fail to pay fees for 30 days past the due date. Additionally, MCC Hosting may limit, suspend, or terminate the Services to you: (i) if you fail to comply with these Terms, (ii) if you use the Services in a way that causes legal liability to us or disrupts others’ use of the Services; or (iii) if we are investigating suspected misconduct by you. Also, if we limit, suspend, or terminate the Services you receive, depending upon the reason, we will endeavor to give you advance notice and an opportunity to obtain a copy of your Content from that Service. However, there may be time sensitive situations where MCC Hosting may decide that we need to take immediate action without notice. MCC Hosting will use commercially reasonable efforts to narrow the scope and duration of any limitation or suspension under this Section as is needed to resolve the issue that prompted such action. MCC Hosting has no obligation to retain your Content upon termination of the applicable Service.
